Buying a property in Turkey is not that difficult as it has been told too many times. Since Europe allows Turkish citizens to own a real estate; Europe citizens may acquire real estate in Turkey

Without having a title deed, called TAPU, you are never condidered to legally own the property even if you signed a legally acceptable purchase contract with the seller.

A TAPU is an official document which shows you have ownership rights over the real estate. The owners full name and photograph and detailed information on the asset appear on this document. Both buyer and seller (or the legally authorised agents) apply to the TAPU Office for transferring the ownership.

In such cases, mutuality principle is the basis. According to the article 35 of the Land Registry Act numbered 2644, acquiring real estate of foreign people in Turkey must be mutual and must be suitable for legal limitations. According to the approach in this regulation, the citizens of the countries who are allowing Turkish citizens to have real estate in their country are allowed to have real estate in Turkey except for the regions that are kept outside of this provision by means of other acts.

RegionalRestrictions
According to the act numbered 2644, foreign people may not acquire real estates in certain regions. Moreover, right to acquire immovable in other regions is subject to the permission of Council of Ministers.

Regions that foreign people may not ever acquire real estates: According to the article 87 of the Law of Village numbered 442, foreign people may not acquire real estates within village boundaries. According to the Law of The Military Forbidden Regions and Safety Regions, the real properties in the said regions are strictly prohibited for foreign people. According to the article 36 of the Act numbered 2644, the foreign people in Turkey cannot acquire more than 30 hectare property out of village boundaries, but this is possible by means of permission of the Council of Ministers.

Considering the above restrictions, getting a real estate is possible within the following regions:

  • Within the city boundaries, out of the military safety regions, without any permission.
  • Separate farms out of village boundaries and again lands that are larger than 30 hectare out of the village boundaries, with the permission of the Council of Ministers.
There is no restriction concerning value and type (land, house, commercial) on acquiring real properties within city boundaries.

Importing household goods via foreign intermediates

•  German citizens coming to Turkey for business, research or education for a certain period of time can take their used household goods for a temporary period with the condition of paying a deposit, for at most two years. At the end of this period they have to be taken out of the country.

•  Foreigners moving into Turkey can bring their used household goods without being subject to any time limits. In this regard permission for residency must be granted from the governorship of the city to be stayed in. Following this, they have to apply for permission for residency in Turkey to the Turkish Ministry of Interior with the guide of the governorship. After granting permission, household goods can be moved to Turkey.


Provisions regarding the right of inheritance


In case of death of the foreigners having real property in Turkey, those real properties are transferred to their inheritors. The inheritors of the foreigner take a hereditary transmission document from the country of which they are citizens. Following the declaration of the foreign court decisions, an execution decision is taken by the Turkish courts based on this decision. The properties of the death person then are transferred to inheritors following this execution decision. Inheritors declare the hereditary transmission and pay a hereditary tax. There is no pre-determined specific tax amount for each inheritor in this case. Their tax share is calculated according to the amount transferred to them.

Earthquake Insurance

Property is to be insured by the owner against the earthquake risks. It is compulsory and a national uniform tarif is applied. Independend of the location in the turkish republic.

In Alanya you cant find a natural gas or central heating systems. Communal heating or electric heating is more frequently observed. Solar energy heating and boiling systems are used.

Foreigners may use their real properties in Turkey ; they may as well rent them to anyone they like. People who rent their real properties and gain over a certain amount are liable of paying income tax. A certain part of the rent incomes are not subject to taxing. Tax reducing costs (repair costs, water costs, electricity etc.) can be added to the amount subject to taxing.
25 per cent of the rent taken from commercial enterprises can be considered as tax reducing cost, the rest is taxed. Income tax starts at 25 per cent of the amount subject to tax. Foreigners having a property in Turkey can sell this property to anyone they want, anytime they want. The sale price can be transferred to foreign countries.
